IT notice 139(9) 1961

Hi Pankaj, I filed ITR for AY2013-14. The tax deducted at source was 5331 INR. And while filing ITR i mentioned my savings account interest of some 4162INR as well (income from other source) and added a entry of same amount for exemption under 80tta. But my form 16 does not have the savings account interest details. Now i received a notice from tax department under 139(9) IT Act 1961, to rectify my returns. What could be the possible issue for this notice? What should i do?

I verified my Form 26AS and it shows the correct deductions of 5331 INR.

Form 16 cannot have interest income details, so there is no question of notice being sent for same.

139(9) notice is issued in case of an defective/incomplete return. There must be some issues in the return filed. Please cross check return file for each entry and it has been mentioned in correct head.

There should be issue mentioned in notice for which they are treating it as defective return.

Ok. I read the notice again and it says, return is considered defective because tax determined as payable in return of income filed has not been paid.

But i see records of payment on TRACES site. Looks like i have to visit the tax department for more clarification.

Thanks for your help. :)

You can file rectification saying that please reprocess the case, no modification is needed in the return.
