Deduction under 80D

Dear Sir, I am Godwin D'Silva (41), Resident Indian Tax Payer. I had purchased mediclaim policy for Self, Spouse and Child for an amount of INR 46,000/- for FY 2018-19(AY 2019-20). However I had incurred additional INR 48,538/- towards hospitalization of my father (72Y) as he does not have medical Insurance policy due to his age factor. We had applied for Medical Insurance for father and mother (64Y) but got rejected due to health condition. Hence I had claimed deduction of INR 73,538/- under section 80D [ INR 25,000/- towards Medical Insurance for Self & Family] plus INR 48,538/- towards medical expenses towards my uninsured dependent parent. However, ITAO rejected my claim and allowed only deduction of INR 25,000/-. I rejected the TD and replied by giving above reasons but again it was rejected out-rightly. Even proof were not even asked. Finally i paid the difference amount as per TD. Therefore my questions are following. 1. Whether my claimed deductions was Incorrect ? I thought if senior citizen dependent parent having no medical insurance, medical expenses can be claimed up to 50,000/- with total deductions up to INR 75,000/- 2. Once I settle the TD, I presume the matter is closed. Is there any additional action is required from my side ?

  1. You were eligible to take the deduction up to Rs 75,000. 25K for your family and 50K for parents.
  2. You can file a case in the tribunal in case you want to fight against IT officer.
