Eligibility of Gratuity


I have completed 4 yrs and 10 months in my company as of today (27/05/2011), and i will be quieting in 15 days(13/06/2011) that is by that time i will be completed with 4 yrs 10 months and 15days. Will i be eligible for Gratuity, please reply to me at msuresh27gmail.com

@ Suresh,

In the payment of gratuity act mentioned the eligibility for gratuity payment period is minimum 5 years for example d.o.j 01.04.2006 and date of leaving should be or more 31.03.2011 then employee is eligible for gratuity payment otherwise not.

There have been court orders under which an employee who has completed 4 years 10 months and 18 days continuously without any break is eligible for Gratuity.

I have worked with an organisation for 8 continuous years. I have left the company 2.6yrs back. What is the time frame of claiming gratuity after leaving the job.

Employer should have paid you gratuity amount at the time of leaving service.
