Company deducts TDS but doesn't deposit to government

Our company deducts TDS from our salary but they don't deposit to government. I checked my form 26AS and it had no entries. Also they refrain form issuing a form -16 . Could you please guide me on how to file Income tax return in this case.

If company does not deposit taxes and does not issue form-16 either and if you file returns on such income, liability to pay taxes would be yours.

If you show TDS in income tax return, your declaration won't match IT department records (form 26AS) and they would send notice to pay due taxes. As you won't be having form-16, you won't be able to prove tax deposit.

Company may face serious issues in case IT department catch them doing same. So employees must unite and ask employer to deposit taxes and issue form-16.
