E Filing, Form 16 and 26 mismatch

I am posting this question on one of my friend's behalf

  1. He is yet to file the returns for the AY 2012-2013, is there any penalty,fine to be paid if he files now ?
  2. There is a mismatch in the tax paid/income info in form 16 and form 26 as. Which one should we consider for e-filing the returns

  1. If there is no pending tax liability, there won't be ant penalty for late filing as of now.
  2. If there is mismatch in form-16 entries and what form-26AS shows, it should be rectified before filing returns. If form-26AS shows less tax paid but form-16 shows more, IT department may demand remaining taxes on basis of their records in form-26AS.
