Gratuity eligibility

I joined the company on 01.08.07 and left on 10.05.12 which makes me eligible for gratuity since I have completed 4 years and 290 days in the company. But, in the initial one year of my service, I was in training period. Could you please confirm, Am I eligible for claiming the gratuity amount. My previous employer is not providing me with their HR policy.

Computation for Gratuity period would start once you are on company's payroll. So in case you were on payroll, that duration would also be counted.

@ Pankaj : I agree that I was on company payroll, but 1st year since it was training period, so no pf was deducted. What procedure should I follow to get the gratuity claim. and how it is calculated. Thanks in advance Regards, Amit

If no PF was deducted that means you were not being treated as regular employee. In that case training period won't be included for Gratuity computation.
