wether capital gain arises on transfer of booking right to other before registration

Dear Sir, I have booked a under construction house property with builder at Noida one year back in the year Dec.'2010 but builder unable to provide me the complete flat within 2 years as per the contract, so, I Want to sell the property and i have find the buyer too. so, my question to you is that wether capital gain will arise on transfer of booking right to other before registration of house property. Waiting for your early reply and oblige.

As property was never registered in your name and if you gain anything from such transaction (selling property), whole gain would be added to your taxable income. This gain would be taxed as per you tax slab rate (max 30%).

There is no way to save income tax on such gain. It will be treated like income.
