NON-PAYMENT OF MY PF BY ORIENTAL INSURANCE CO. LTD.

Sir,

I am a member of the Employees Provident Fund in The Oriental Insurace Co.Ltd., Mumbai for the last 30 years. I resigned from the company on 16th July 2007, but the same was not ccepted by the company and I was considered on Leave without pay till date. As per eligibility, I applied for my daughter's marriage loan in Oct'10 which was never given to me ( I recd no response) and my daughter's marriage could not be done due to paucity of funds. Again I looked for a boy and applied a fresh loan against my PF in July'10 - this again met with the same fate. I had to borrow money from my relatives for the mariage, which has to be returned now. Sir. you would appreciate that this is my life's savings and one saves money for this occassion. Sir, I am in a very bad shape. I am a pension optee and the entire money belongs to me, with no contribution of the comapny. I AM NOT ABLE TO GET MY OWN MONEY BACK, WHICH THE COMPANY IS HOLDING BACK FOR NO REASON GIVEN TO ME. Sir, the comapny is not giving me my money and no pension is also being given to me. SIR, I WOULD REQUEST YOU TO KINDLY HELP ME IN GETTING MY MONEY BACK FROM ILLEGAL HOLDING OF THE COMPANY. You can submit EPF withdrawal forms to EPF office.
If your employer is not signing EPF documents, get your signature verified from a bank Manager, any gazetted officer, by Member of the Central Board of Trustees. / committee / Regional Committee (Employees' Provident Fund Organization) or Magistrate / Post / Sub Post Master / President of Village Panchayat / Notary Public and submit the Form to the PF office with a covering letter mentioning clearly the reason why you were not able to get form verified by previous employer.

Thanks a lot for the quick response, but as I am a member of the PF run by the Trust of Oriental Insurance, I am told that any withdrawl / loan from the same is to be fcountersigned and forwarded by the employer. Is this correct or I can get my PF withdrawn from them through the PF office??? Pls suggest remedy. Thanks & Regards Naresh Vig

In case PF is run by trust then it has to be sent by employer only. EPF department has nothing to do with this in this case. You should try to sort out issue with employer only. If that does not work, contacting government labor department will be only left option. Please consult a lawyer good in labor laws.
